Terms & Conditions

We appreciate and value your business. This Bulk Gift Card Agreement (Agreement) governs each purchase of MasterCard® Gift Cards (Gift Cards) that you make. The terms you and your refer to the person or entity purchasing the Gift Cards. The terms we, our and us refer to Fifth Third Bank, National Association, and our successors or assigns.

1. Order Approval. By submitting this order, you are giving Fifth Third Bank the authority to produce, fund, and ship Gift Cards on your behalf. By approving your order, you agree to the terms and conditions contained herein.
2. Payment and Shipment. Your Gift Card order must be funded from an existing Fifth Third account. By placing a card order online or by other means, you are giving us authority to debit your Fifth Third account for the amount of the card balances, plus any applicable fees. After verification of funds, we will ship your order of Gift Cards.
3. Order Cancellation. If you cancel your order at any time after we receive your payment, we reserve the right to charge you a Gift Card Issuance Fee, as listed in the Fee Schedule, even if you return the Gift Cards, which you must do at your own risk and expense.
4. Activation. Cards must first be activated before they can be used for purchases. The gift card recipient activates the card by calling a toll-free number and entering the code printed on the back of the card.
5. Gift Card Terms & Conditions. You agree that you have read and understand the terms and conditions governing the use of the Gift Cards (Fifth Third Bank Loyalty/Award/Promo MasterCard Gift Card Terms & Conditions), a copy of which is available online or by contacting your Fifth Third Bank representative, and that you will provide the Terms & Conditions packaged with each Gift Card to each person to whom you provide a Gift Card.
6. Transferability Limitations. You may only give the Gift Cards away as a gift. You may not sell the Gift Cards to other persons or entities or use the Gift Cards in any betting, gambling or illegal transactions. Examples of permitted use of the cards include, but are not limited to, consumer retention programs, sales promotions, rebate programs, sweepstakes or contests, referral programs, incentive programs for employees, or charitable/community relations programs. You are prohibited from reselling or redistributing the card to consumers primarily for personal, family, or household purposes. You agree that you will not give a Gift Card to any person who lives in the following states where our Gift Card program is unavailable: Connecticut, Hawaii, Maine, Massachusetts, New Hampshire, New York, Rhode Island, and Vermont.
7. Gift Card Safeguards. Once you receive the Gift Cards, you agree to secure them with at least the same level of protection with which you secure your own sensitive materials. You are responsible for any loss, theft or unauthorized use of the Gift Cards once you have received them and while they are in your possession. You agree to notify us immediately if the Gift Cards are lost or stolen by calling 866-466-0059. At your request, we will issue new Gift Cards to you and will charge you a Gift Card Issuance Fee for each card issued. You will be asked to follow the same order approval process as described in Paragraph 1.
8. Refund Policy. If we have received your payment and you request a refund after canceling or not approving an order, we will refund the amount paid minus any applicable fees within 30 business days after we receive your refund request. All refund requests must be made in writing. In addition, if you cancel an order after receiving the Gift Cards, you must return the Gift Cards to us by secure means in order to receive a refund. You will be responsible for the cost of returning the Gift Cards to us and for any loss, theft or unauthorized use of the Gift Cards until they are in our possession.

10. Purchase Limitations. We reserve the right to limit the number of Gift Cards that you may purchase at any given time. We also reserve the right to limit or stop your distribution of Gift Cards as we deem necessary to comply with applicable law, including, but not limited to, the Bank Secrecy Act, the USA Patriot Act, and economic and trade sanctions administered by the U.S. Department of the Treasury, applicable to your purchase and distribution of the Gift Cards.
11. Documentation and Identification. To avoid possible fraud or other problems with your Gift Card purchase, all documentation you provide to us in connection with the purchase must be in a form satisfactory to us. We may from time to time request additional information from you to protect you and our systems from fraud or other problems and to comply with applicable laws. We reserve the right to reject a Gift Card order if such documentation or information is not satisfactory.
12. Applicable Law. This Agreement is governed by, and interpreted under the laws of the State of Ohio, without reference to principles of conflict of laws. You agree to comply with any laws, regulations and MasterCard® operating rules.
13. Unclaimed Funds. The Available Funds on the Gift Cards may become "abandoned property" under applicable state law if you do not give the Gift Cards away as a gift and have not corresponded with us concerning your Gift Cards or if the Gift Cards are not used by the recipients.
14. Limited Liability. Unless we have acted in bad faith or are otherwise prohibited under applicable law, we will not be liable to you for performing (or failing to perform) our services under or in connection with this Agreement. Without limiting the foregoing, we will not be liable for delays or mistakes that happen because of reasons beyond our control. If a court finds that we are liable to you because of what we did (or did not do, as the case may be) under or in connection with this Agreement, you may recover from us only your actual damages. In addition, you agree that you will be liable to us, to the extent permitted by applicable law, for any losses we may suffer as a result of your failure to comply with this Agreement or with any applicable law.
15. Reimbursement of Losses. If we take any action to collect any amounts you owe to us under this Agreement or to defend ourselves in a lawsuit brought by you where we are the prevailing party, you agree to reimburse us for our losses, to the extent permitted by applicable law.
16. Disclosure of Information to Third Parties. We will disclose information to third parties about your Gift Cards or transactions made on them where it is necessary to complete this transaction; in order to comply with government agency or court orders or as otherwise required by law or in connection with examination by banking authorities; if we conclude that disclosure is necessary to protect your or our interests; or if you give us permission.
17. Severability. If any provision of this Agreement is deemed to be invalid, illegal or otherwise unenforceable by a court or other governmental agency with proper jurisdiction over us, that provision will continue to be enforceable only to the extent permitted by that court or agency. All other provisions of this Agreement will, however, remain in full force and effect.
18. Entire Agreement and Amendments. This Agreement constitutes the entire agreement between the parties. We may delay or waive any of our rights at any time without waiving any of our rights at any future time. Except as otherwise required by applicable law, we may amend at our sole discretion any part of this Agreement at any time by providing written notice to you. If any such notice is returned to us as undeliverable because of any reason that is not our fault, the changes described in that notice are still binding on you.
